These Terms of Service govern access to and use of kuunioli.com and purchases made through the website. The website is operated by Kuunioli. By using the website or placing an order, you agree to these Terms and the policies referenced in them. If you do not agree, do not use the Services.
You must be at least the age of majority in your jurisdiction and legally capable of entering a contract to place an order. You are responsible for providing accurate information, protecting account credentials, and all activity performed through your account. Notify us promptly if you believe an account or payment method has been used without authorization.
We try to keep product descriptions, specifications, images, prices, inventory, and availability accurate. Screen settings, photography, product updates, manufacturing tolerances, and packaging changes may cause reasonable differences. Measurements and performance claims apply under the conditions stated on the product page, packaging, or manual. If material information is incorrect, contact us before using the product so we can review the available remedy.
Submitting an order is an offer to purchase. An order-confirmation message acknowledges receipt but does not necessarily constitute acceptance. We may accept, decline, limit, or cancel an order for legitimate reasons, including inventory errors, pricing errors, payment authorization failure, suspected fraud, shipping restrictions, resale activity, or an incorrect address. If we cancel an order after payment is captured, we will refund the canceled amount to the original payment method.
Prices are shown in the currency displayed at checkout and may change without notice before an order is placed. Applicable sales tax and any optional charges are shown at checkout. Free standard shipping applies only as stated in the Shipping Policy. Discount codes and promotions may have separate terms, may not be combined unless stated, and may be changed or ended for future orders. You authorize our payment providers to charge the payment method selected at checkout for the total displayed amount.
Shipping is governed by the Shipping Policy. Estimated dates are not guarantees. To the extent permitted by law, risk of loss transfers when the order is delivered to the shipping address provided at checkout. Nothing in this section limits rights available for a package lost in transit or a delivery that does not conform to the order.
Returns, cancellations, refunds, and exchanges are governed by the Return and Refund Policy. The policy is incorporated into these Terms. Merchant Center settings, checkout information, promotions, and customer-service messages should be interpreted consistently with the policy posted on kuunioli.com at the time of purchase, subject to applicable law.
Kuunioli products may include powered snow-removal equipment, lithium-ion batteries, chargers, moving parts, and other components that can cause injury or property damage if misused. Read and follow the product manual, labels, warnings, charging instructions, maintenance instructions, and local rules before assembly or use. Wear the protective equipment specified in the manual. Keep hands, clothing, children, pets, bystanders, cords, and loose objects away from moving parts and the discharge path.
Use only compatible batteries, chargers, replacement parts, and accessories identified for the product. Do not modify safety devices, operate a damaged product, charge a damaged battery, or use equipment outside its stated conditions. Product selection, site conditions, snow depth and type, surface conditions, weather, and operator conduct remain the user's responsibility.
Any product warranty is limited to the written warranty, if any, displayed on the applicable product page, included with the product, or otherwise provided at purchase. A warranty does not cover misuse, unauthorized modification or repair, incompatible batteries or chargers, accidents, improper storage, normal wear, or failure to follow instructions, except where applicable law provides otherwise. The 30-day Return and Refund Policy is separate from any product warranty.
If you submit a review, photograph, video, suggestion, or other content, you represent that you have the right to submit it and that it is accurate and lawful. You grant Kuunioli a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, reproduce, adapt, publish, translate, and display that content for operating, improving, and promoting the Services, subject to applicable privacy law. We may moderate or remove content that is unlawful, misleading, infringing, abusive, or unrelated.
You may not use the Services to violate law; infringe intellectual-property or privacy rights; transmit malicious code; scrape or access the website by unauthorized automated means; interfere with security or operation; impersonate another person; submit false payment, order, or return information; exploit pricing or promotional errors; or purchase products for unauthorized resale. We may suspend access or cancel affected orders where reasonably necessary.
The website and its text, graphics, product photographs, videos, logos, layout, software, and other content are owned by or licensed to Kuunioli and are protected by applicable intellectual-property laws. These Terms grant only a limited, revocable, non-transferable right to use the website for personal shopping and information. No content may be copied, republished, sold, or commercially exploited without written permission, except as permitted by law.
The Services may use or link to third-party platforms, payment services, carriers, social networks, applications, or websites. Kuunioli does not control third-party services and is not responsible for their independent terms, content, availability, or practices. Your use of them may be subject to separate agreements.
To the maximum extent permitted by law, the website and its general informational content are provided on an "as is" and "as available" basis. Kuunioli does not warrant uninterrupted or error-free website operation. Product warranties and non-waivable consumer guarantees remain governed by their written terms and applicable law. No general website statement replaces the safety instructions supplied with a product.
To the maximum extent permitted by law, Kuunioli will not be liable for indirect, incidental, special, punitive, or consequential damages, or loss of profits, revenue, data, goodwill, or business opportunity arising from use of the Services or products. To the maximum extent permitted by law, Kuunioli's aggregate liability relating to an order will not exceed the amount paid for the product giving rise to the claim. These limits do not apply where prohibited, including liability that cannot legally be excluded or limited.
To the extent permitted by law, you agree to indemnify Kuunioli against third-party claims, losses, and reasonable costs arising from your unlawful use of the Services, violation of these Terms, infringement of another person's rights, or misuse or unauthorized modification of a product. This section does not apply to the extent a claim was caused by Kuunioli.
These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles. Courts located in Hong Kong will have jurisdiction over disputes, except where mandatory consumer law permits or requires a claim to be brought in another forum. Before filing a claim, contact service@kuunioli.com and provide the order number and a description of the issue so both parties can attempt to resolve it.
We may update these Terms by posting a revised version with a new effective date. Changes apply prospectively unless law requires otherwise. If any provision is held unenforceable, the remaining provisions remain effective. These Terms and the policies incorporated by reference form the agreement concerning use of the Services and do not eliminate rights that cannot be waived under applicable law.
